Welcome to momentum-trader.ai. By accessing this website or subscribing to our emails (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

1. What we provide

momentum-trader.ai publishes general, impersonal market research and educational content, including a free daily email highlighting stocks showing strong price momentum. The Service is informational only. It is not investment advice and does not account for your individual circumstances. Please read our Disclaimer, which is incorporated into these Terms.

2. Not advice; your responsibility

Nothing in the Service is a recommendation to buy, sell, or hold any security. You are solely responsible for your own investment decisions and for any resulting gains or losses. Trading involves substantial risk, including loss of principal.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

4. The email subscription

When you subscribe, you consent to receive the daily email and occasional related messages. Delivery is provided through our email platform (currently beehiiv). You can unsubscribe at any time using the link in any email; doing so ends your subscription. We may change the format, timing, or content of the emails, or discontinue them, at any time.

5. Acceptable use

You agree not to: (a) copy, resell, redistribute, or republish our content without permission; (b) scrape, harvest, or use automated means to access the Service beyond normal reading; (c) attempt to disrupt or gain unauthorized access to the Service; or (d) use the Service for any unlawful purpose.

6. Intellectual property

All content, branding, logos, and design on the Service are owned by momentum-trader.ai or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable license to access the content for your own individual, non-commercial use.

7. No warranty

The Service is provided “as is” and “as available,” without warranties of any kind. We do not warrant that content is accurate, complete, timely, or error-free, or that the Service will be uninterrupted or secure.

8. Limitation of liability

To the fullest extent permitted by law, momentum-trader.ai and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading or investment losses, arising from your use of or reliance on the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim (which, for the free Service, is zero) or USD 100.

9. Indemnity

You agree to indemnify and hold harmless momentum-trader.ai and its operators from any claims, losses, or expenses arising from your use of the Service or your breach of these Terms.

10. Third-party links

The Service may link to third-party sites or services we do not control. We are not responsible for their content, policies, or practices.

11. Changes

We may update these Terms from time to time. Material changes take effect when we post the updated Terms with a new “last updated” date. Your continued use after changes means you accept them.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason. You may stop using the Service and unsubscribe at any time.

13. Governing law

These Terms are governed by the laws of the United States and the state in which the publisher operates, without regard to conflict-of-laws rules. Any disputes will be resolved in the courts located there.
